Gov. Charlie Baker's vaping ban will be replaced by a permanent law passed by the state legislature banning the sale of all flavored nicotine vaping products, which takes effect immediately.
In an effort to combat under-age vaping, the state House of Representatives overwhelmingly voted to ban the sale of flavored vapes and institute a 75 percent tax on all other vaping products.
This comes after the Massachusetts Superior Court ruled that the state Department of Public Health did not have the authority to regulate cannabis vaping products used by medical marijuana patients.
While the vaping ban survived a lawsuit filed by the Vapor Technology Association, a state judge ruled that Governor Baker must take steps to ensure he is not crossing legal boundaries.
