Sabo trial pushed back to late May

Pre-trial motions were delayed again yesterday in the trial of Boston University ice hockey assistant captain John Sabo for assault, assault and battery and threats against BU student Christopher Boccuzzi.

The new date is set for May 22.

The delay was granted to provide Sabo’s lawyers enough time to acquire and examine evidence recently obtained by the Suffolk County District Attorney’s office. The defense needs documents subpoenaed from BU’s Office of Judicial Affairs and medical records from St. Elizabeth’s Hospital, according to lawyer Steven Grossberg.

According to David Procopio, spokesman for the Suffolk County District Attorney, the delay is not unusual, and BU’s subpoena was just “procedural work.”

The Office of Judicial Affairs did not return several phone calls yesterday.

Sabo, a Metropolitan College senior, is accused of attacking School of Management senior Boccuzzi last Sept. 22 outside The Avenue, a Brighton bar.
